"You" and "the model(s)" refer to the person named in the details given at the time of registration as a contributing model. "website" includes any storage area, facilities and electronic functions controlled by TTA. "material" includes any digital-produced material capable of being rendered into an intelligible form on any computer device. It includes, photos, videos and text "upload" means to cause to be transferred to any website managed by TTA. "account" means that area of any TTA website specifically allocated to and managed by you and protected against public access by a password supplied by you. All other words have their normal English meaning. 1.2 Changes TTA reserve the right to change these terms and conditions ar any time. In such an event, all resgistered models will be notified via email and will be required to confirm their continued understanding and acceptance thereof withn 28 days. 2. RESPONSIBILITES of TTA 2.1 TTA will provide an account on our website for your use. The account will allow uploading of material that will become publically displayed in an area of the website to which paying customers will have access after verification of their payment details by our Internet payments processor, "CCBill". 2.2 Your account will provide a link to the TTA/CCBill payment facility, and a record will be made of any customers who use your link to gain access to the website. Each such event is known as a "signup". Your account will be credited with 60% of the value of such signups aftre the CCBill processing fee has been deducted. Customers will be given access to all models' websites upon signup, but only the account used to initiate the signup will be credited. 2.3 On the first of the month, all acounts which exceed TTA's minimum payment level (£100 as of 20 August 2006) will have those funds paid by postal cheque using the details provided by you. Any amount less than the the minimum will be held in reserve and "rolled over" into the following month's account. 2.4 Any refunds, chargebacks or cancellation fees charged by CCBill will be deducted from thre relevant model's account. 2.5 Your account status will be shown to you whenever your account is accessed. 2.6 TTA will promote and advertise its own overall website, and be responsible for generating Internet traffic to the TTA site as a whole. In order to do so, TTA require that reasonable samples of material uploaded by you are used in such promotions and advertising. TTA will not use any of your material commercially in any other way without your express permission. 2.7 TTA will stamp all photos with a generic logo and also a copyright message identifying the model's own website - however the copyright remains with the model, with assumed permission for TTA to use the photos in accordance with para 2.6 above. 2.8 TTA reserves the right to add links of its own choosing to each individual models "links page". These will be clearly marked as "webmaster's links" and be distinct from links that you manage on your own account. 3. RESPONSIBILITIES of THE MODEL 3.1 It is your responsibility to ensure that all material that is uploaded using your account does not breach any of the terms and conditions laid down by TTA and derailed below in "PROHIBITED CONTENT". Your password should not be revealed to any other person. 2.2 You are responsible for promoting and advertusing your own account. Generally this will be in the form of links to and from other websites, but must NOT include unsolcired email. 2.3 You are required to provide ar least one set of photos for a free area of the website before being allowed to upload paying sets. It must contain at least 12 photos. You may provide more if you so choose. 2.4 Sets of photographs for the pay area may be uploaded at any time you decide. There is no minimum requirement. 3. PROHIBITED CONTENT: The following activies are prohibited: 3.1 Uploading of any photos depicting models APPARENTLY under 18, in the opinion of the webmaster of TTA. Any content that TTA believe breaches this rule will result in the Legal authorities being notified immediately both in the UK and in the county of origin of the IP address that caused the upload. Similarly, any model name that includes "teen" "schoolgirl" "lolita" or any such phrase SUGGESTING such content will result in the removal - without notice - of the relevenat section of the website. 3.2 Uploading of photos for which you do not have the permission of the copyright owner AND all the models depicted. Any complaint received will result in account suspension until a THOROUGH and fair investigation is conducted. TTA will not consider anonymous complaints, i.e. we will not suspend your account unless we receive verifiable contact details from the complainant. In the interests of natural justice, you will be provided with an opportunity to reply. If after investigation of both a verified complaint and your reply, our opinion is that a breach has occurred, we will provide your full details to the complainant on request. The complainant will need to provide substantial documented proof of his/her claim in order to prevent malicious and / or mischevous allegations 3.3 Uploading of any material, photos, videos or text that would be deemed illegal or defamatory in an English court. If you are unsure, DO NOT UPLOAD THE MATERIAL. TTA inyends to take all reasonable steps to ensyre that all its content is legal in the UK, and will immediately reomve - without notice - which it believes breaches this condition. Guidelines provided by the BBFC guidelines should be consulted if there is the slightest doubt: http://www.bbfc.org.uk/classification/c_R18.php 3.4 The use of unsolicited email (or "spam") to promote either TTA or your personal TTA site. By this we mean the sending of emails by any person to recipients whom you do not personall know, unless those recipients have explicitly requested such emails. 4. ACTIONS: 4.1 In the event of a breach of any of the conditions listed under "PROHIBITED CONTENT", TTA will take the following actions, in addition to those mentioned specifically above: 4.2 TTA will publish your details on the "named and shamed" section of the website, and you will be permanently banned from any website associated with TopTenAmateur.com. 4.3 TTA will recover all funds accumulated on your account, and any cheques issued but not yet cashed will be stopped.
